Many Pennsylvania Police Departments haven’t implemented body-camera technology because
existing laws leave officers in violation of wire tap laws if the record inside a private residence. Turning cameras off when responding to an emergency is unrealistic.
A new law effective Septer 5th 2017 (ACT 22) permits law enforcement to record audio inside a residence and also exempts the release of audio/video recording from the Right-to Know Law.
The current wiretap law prevents law enforcement from intercepting audio recordings inside a residence. A violation by a law enforcement agent could have subjected a police officer to criminal charges.
The new law exempts the following from the definition of “oral communications”
- An Electronic communication and
- “A communication made in the presence of a law enforcement officer on official duty who is in uniform or other wise clearly identifiable as a law enforcement officer and who is using an electronic, mechanical, or device which has been approved under S570(B) relating to the exceptions to prohibitions in possession, sale, distribution, manufacture, or advertisement of electronic, mechanical or other devices, to intercept the communication in the course of law enforcement duties”
By amending the definition of “oral communications” it takes the officer’s interception of audio/video recordings outside previously limited exception, permitting identifiable law enforcement officers on duty to intercept video and audio recordings at or in any place at any time.
